On February 19, 2016, the United States District Court for the Northern
District of California granted O&N’s motion for partial summary
judgment holding that Federal Insurance Company breached its duty to defend
O&N client Medeanalytics, Inc. Judge Jon Tigar ruled that allegations
in an underlying complaint that the insured had made “disparaging
statements” about the claimant were sufficient to reveal a potential
for coverage under the personal injury coverage for defamation in the
Federal policy. The court also rejected Federal’s argument that
the “Breach of Contract” exclusion eliminated Federal’s
duty to defend.
