On September 7, 2011, the United States District Court for the Eastern District of California granted O&N client, Bel Air Mart’s, motion for partial summary judgment regarding its right to be defended in underlying CERCLA litigation by independent counsel, sometimes called “ Cumis Counsel,” pursuant to California Civil Code section 2860.
