Ninth Circuit Rules in Favor of O&N Client Regarding Hartford's Duty to Defend

On June 18, 2008, the Ninth Circuit Court of Appeal issued an unpublished decision reversing a trial court’s grant of summary judgment against O&N client, Tradewind Products, Inc., and in favor of Hartford Fire Insurance Company. The Ninth Circuit ruled that Hartford owed a duty to defend Tradewind in an underlying lawsuit which alleged an “advertising injury” potentially covered by Hartford’s policy. The Ninth Circuit reversed and remanded the case back to the trial court for further proceedings
