On May 18, 2010, the United States District Court for the Southern District of California affirmed an arbitration award on behalf of O&N client, North County Ob-Gyn (“NCOG”), against its liability insurer, Illinois Union Insurance Company (“Illinois Union”). The arbitration addressed whether legal fees paid by Illinois Union eroded NCOG’s policy limit. A panel of arbitrators ruled in NCOG’s favor, and District Court Judge Larry Burns affirmed that decision.
